- 1:47Trump's appeal faces long odds: legal expertReuters VideosSTORY: :: A legal expert says Trump's appeal against his conviction in New York faces long odds :: "I think, Any Defense appellate lawyer would take a look at the statute and would raise questions about whether the statute itself, under which Mr. Trump was prosecuted, might be unconstitutionally void, or, as the term is usually used in criminal law, void for vagueness. TRIM So I think that will be the starting point." :: May 31, 2024 :: Abbe Smith, Defense attorney and professor at Georgetown Law :: "I don't think there are many evidentiary issues that might arise on appeal. And that's the second thing a defense lawyer would look to. If the statute is vulnerable to a challenge, you start there, and then you start looking and figuring out whether the judge might have allowed some evidence in that he shouldn't have or prevented some evidence from coming in for the defense that he should have." :: "And there's a third conventional appellate issue, which is whether counsel was effective as a matter of constitutional law under the Sixth Amendment. And there I think, perhaps defense counsel's failure to object to the testimony by Stormy Daniels suggesting that the sexual encounter between her and Mr. Trump was anything other than consensual, might be fertile grounds for an appeal challenging the effectiveness of counsel." :: "So this is not a quick process. I don't see, even if the Appellate Division regards this case as special and urgent because of the presidential election, I still don't see that happening before November." It is unlikely any appeal would be resolved before the Nov. 5 election, in which Trump, the Republican presidential candidate, is set to square off against Democratic President Joe Biden. Twelve jurors found Trump guilty of fudging records to cover up his former lawyer Michael Cohen's $130,000 payment to Daniels for her silence before the 2016 election about the alleged 2006 encounter. To prevail on appeal, Trump, 77, must demonstrate that Justice Juan Merchan made significant errors in overseeing the trial.4 days ago
- 1:00'No one is above the law': Biden on Trump's verdictReuters VideosSTORY: :: President Biden says the guilty verdict in Trump's hush-money trial proves 'no one is above the law' :: May 31, 2024 :: Washington, D.C. "The American principle that no one is above the law was reaffirmed. Donald Trump was given every opportunity to defend himself. It was a state case, not a federal case. "The jury heard five weeks of evidence, five weeks. After careful deliberation, the jury reached a unanimous verdict. They found Donald Trump guilty on all 34 felony counts. Now he'll be given the opportunity as he should, to appeal that decision just like everyone else has that opportunity. That's how the American system of justice works. And it's reckless, it's dangerous, it's irresponsible for anyone to say this was rigged just because they don't like the verdict. Our justice system has endured for nearly 250 years, and it really is the cornerstone of America, our justice system." The comments from the White House were Biden's first public remarks on the verdict that was rendered on Thursday (May 30).4 days ago

- 2:26Trump says he will appeal historic convictionReuters VideosSTORY: :: New York DONALD TRUMP: “So we're going to be appealing this scam… “ Donald Trump said on Friday he will appeal the guilty verdict that made him the first U.S. president convicted of a crime. That's after a jury found him found guilty of all 34 criminal counts he faced for falsifying documents to cover up a hush money payment to porn star Stormy Daniels. "So, we're going to show them that we're going to fight.” "It's a rigged, it was a rigged trial." :: Washington, D.C. U.S. PRESIDENT JOE BIDEN: "It's irresponsible for anyone to say this was rigged just because they don't like the verdict." U.S. President Joe Biden said Trump had an opportunity to defend himself in the same justice system that applies to all Americans. "The American principle that no one is above the law was reaffirmed." The question now: how will this affect the upcoming presidential election? In a new Reuters/Ipsos poll - ten percent of registered Republican voters said they were less likely to vote for Trump following the verdict. Reuters correspondent James Oliphant: "Polling is one thing and it can tell us a lot about what people will say they would do but sometimes it's not a great predictor of future behaviour." :: File "Really, is someone prepared to switch parties, especially if they are traditional Republicans, to vote for the other side? And there’s very little precedent for that." :: FIle "You have Biden with a 37 percent approval rating and someone who is viewed by a lot of Republicans as someone who has done harm to the country. He is not exactly a traffic driver, if you know what I mean." :: May 30, 2024 Thursday's verdict catapults the U.S. into unexplored territory before the November 5 vote. :: File Trump's campaign said it raised $35 million from small donors after the verdict, nearly double its previous daily record. National opinion polls show Trump and Biden locked in a tight race. :: May 30, 2024 “Just simply, I don't think we need a convict in office.” “My president's got street cred now.” TRUMP: "If they can do this to me, they can do this to anyone..." Falsifying business records carries a maximum sentence of four years in prison. Others have typically received shorter sentences, fines or probation. Trump must wait until after his July 11 sentencing before appealing.4 days ago
