The E-3 program, enacted on May 11, 2005, applies to employers seeking to hire nonimmigrant aliens from Australia as workers in specialty occupations. The E-3 program is governed by the labor certification standards that apply to H-1B and H-1B1 programs.
The E-3 visa is a United States visa for which only citizens of Australia are eligible. It was created by an Act of the United States Congress as a result of the Australia–United States Free Trade Agreement (AUSFTA), although it is not formally a part of the AUSFTA.
The E-3 visa classification applies only to nationals of Australia, their spouses and children under the age of 21. E-3 principal applicants must be going to the United States solely to work in a specialty occupation.
