It depends on whether or not the member has legal and physical custody of any children, pays child support, and/or lives in single-type Government quarters. If a member has legal and physical custody of children, then the member is authorized BAH at the with-dependent rate if not assigned adequate family-type Government quarters.
If he lives in the barracks and pays child support, he would get BAH-DIFF. Child Support must be at least equal to the BAH-DIFF rate. If he is approved to be out of the barracks and pays child support, he gets BAH with dependents. See DoD FMR, Volume 7a, Chapter 26.
