Nov 22, 2008 · Card check doesn't allow labor leaders to forgo anything. It allows workers to do so. The Employee Free Choice Act does nothing to modify the National Labor Relation Act's provision ensuring that if 30 percent of workers want a secret ballot election, one will be held.
In that, a petition or an authorization card with the signatures of at least 30% of the employees requesting a union is submitted to the National Labor Relations Board (NLRB), who then verifies and orders a secret ballot election. Two exceptions exist.
An employer currently can refuse to accept the results of a card check election and require a secret ballot election.
The evidence is clear: secret ballot elections are a far superior method of deciding unionization than the “card check” process.
