SEGA technically do own the rights for 1&2 OST but every time they use the songs they have to pay royalties to the composer. They can afford it when they want to, like Generations or Mania, but they would rather not deal with it if they can avoid It, like how Forces has unique tracks for Green Hill, Chemical Plant and Death Egg.
