Kirk does not object to the personnel, and consents to both the services of Shaw as prosecutor and Stone as President Judge of the court.
The title of this episode is self-explanatory: based on computer evidence, Kirk appears to have either panicked or, worse, acted with malice during a critical point on the bridge while one of those ion storms was raging, causing the death of a crew member with a push of a button.

Kirk soon finds himself facing (you guessed it) court martial, and who does the prosecution turn out to be? Areel Shaw, one of Kirk's old girlfriends! For his own attorney, Kirk gets Samuel T. Cogley, a crazy old Luddite who doesn't use his computer, insisting that the law "really" exists in books.
Jun 11, 2009 · Kirk is insulted and demands an immediate general court martial. Kirk runs into Areel Shaw at the bar (still in her ugly green dress) and tries to pick up where they left off “four years, seven months, and an odd number of days” ago.
After an automated report concerning the death of a crewman conflicts with Kirk’s testimony, the Enteprise captain is court martialed on the charge of criminal negligence. To further complicate matters, one of Kirk’s old girlfriends, Areel Shaw (Joan Marshall), turns out to be the prosecuting attorney.
Captain Kirk finds himself facing a court-martial following the death of crewman Lt. Cmdr. Ben Finney. He and Finney had once been good friends since meeting at the academy, even though Kirk later was the man who reported him once while on watch.
