In the state of New Jersey, you can be issued a DUI if you are caught driving under the influence of drugs or alcohol. If you are under the influence of either of those two substances, you cannot drive or operate a car, bus, truck, boat or any other motor vehicle. This is against NJ law.
The reason being New Jersey law doesn’t classify DUI as an indictable crime (which would be equated with a felony in other states) or a disorderly persons offense (equated with a misdemeanor in other states) like they do other criminal offenses. New Jersey law sets forth a provision for mandatory jail time of 2 to 90 days. The 2-day minimum may not be suspended or served on probation, but it doesn't have to be in the county jail. The time can be served either in an in-patient rehabilitation program or in the Intoxicated Driver's Resource Center (IDRC).
