Local governments exercise only those powers that are granted to them by the states, and a state may redefine the role and authority of local government as it deems appropriate. The country has a long tradition of local democracy (e.g., the town meeting ), and even some of the smallest areas have their own governments.
Powers of Local Governments. The U.S. Constitution neither delegates nor reserves powers to local governments; there is no mention of them. Lacking constitutional status, local governments are at the legal mercy of the states, which have imposed the ultra vires rule.
Application. The most precious powers a city in Florida has are its Home Rule powers. The ability to establish its form of government through its charter, and to then enact ordinances, codes, plans and resolutions without prior state approval is a tremendous authority.
