Nov 24, 2011 · Fox decided to air it during the second season. This was explained during its original airing. The Fox promos for that episode explained it as a 'lost 1st season episode'. That's why Charlie's there, and there's no attention drawn to his presence, as he was always around during season 1.
The episode features a reappearance of Kirk Acevedo as Charlie Francis, whose character was already killed off in the second season premiere. However, Acevedo's character was still alive in the series' continuity when the episode was produced.

In a departure from the previous season, the second season aired in a new competitive timeslot at 9:00 pm on Thursdays. It contained 22 episodes, plus an unaired episode that was produced during the first season; "Unearthed" aired as a special as episode 11 of season two, days prior to "Johari Window", the first new episode of 2010.
